Alimony


The Court decides whether you should receive or pay alimony or spousal support based on the following factors: the circumstances of both of you and your spouse (this may include issues such as income disparity, education disparity, debts, and other factors), the duration of the marriage, the history of contributions to the marriage by each party (including contributions to the care and education of the children and interruption of personal careers or education opportunities for the care of children) and the ability of the supported party to engage in gainful employment without interfering with the interests of any minor children in his or her custody.

As you can see, there is no set formula for determining whether you will pay or receive alimony, or if so, how much. As your attorneys, we can request financial data and based upon our experience, tell you what we believe may happen with respect to alimony. However, the judge makes the final decision unless a settlement is negotiated.
