Discovery
After the temporary hearing, you will probably spend at least a few months separated from
your spouse and operating under the terms of the temporary order. During this time, the
attorneys will engage in what is called the "discovery process". We will ask your spouse
to answer questions in writing concerning your assets, debts, income and expenses.
Opposing counsel may request that you answer such questions in writing as well. You are
likely to exchange documents such as loan information and retirement account statements.
The attorneys may also take "depositions", which are recorded statements taken from witnesses
and/or parties to the divorce, under oath. These statements are taken for the purpose of
preparing for trial. Depending on the complexity of your case, a variety of discovery
techniques may be used by your attorney and/or opposing counsel. The many issues resolved
via divorce should not be undertaken lightly. The discovery process helps you make informed
decisions, as we discussed above.
