Residence Requirement
One of the first things you need to determine before you file a Complaint for dissolution
of marriage (i.e. divorce) is whether you have lived in the State of Nebraska for more
than one year. If you have not, you can file a Complaint for legal separation and convert
that action into a divorce once you have met the residency requirement. A legal separation
entitles you to all of the same rights as a divorce action (i.e. child support, alimony,
custody, etc.), except that the marriage itself cannot be dissolved. There are also other
exceptions to the residency requirement that may be applicable, and we will ask you questions
to determine if these rules are at issue.
